EVN has required EVNEPTC to carry out COD acceptance for wind power plant projects in accordance with terms and conditions of the signed power purchase agreements (PPA).
As for projects that have not received "written approvals from the Ministry of Industry and Trade or the provincial Departments of Industry and Trade on review results of acceptance for project completion to put projects into use", EVN has authorized the Director of EVNEPTC to negotiate amendments to power purchase agreements according to legal regulations; accordingly, a commitment of the seller is added as follows:

The power seller is committed to strictly complying with the laws on capital investment and construction (including the review of project acceptance by competent authorities). In case, the competent authorities views that the power seller does not respect the laws on capital investment and construction, the power purchaser is entitled to reject or cancel COD acceptance, terminate the purchase of electricity and request the power seller to reimburse all the payments that have been made by the purchaser since the COD, including interest (if any).
The power seller is committed to following the decisions of the competent authorities and reimbursing to the power purchaser all the payments that have been made by the power purchaser from the COD, including interest (if any).
The power seller is committed to undertaking the commitments, without any complaints or lawsuits if the above cases occur.
For contract amendments as presented above, EVN has authorized EVNEPTC to negotiate, sign and implement them.
EVN has requested EVNNLDC to put wind power plant projects into operation only after they are accepted for COD and receive "written approvals from the Ministry of Industry and Trade or the provincial Departments of Industry and Trade on review results of acceptance for project completion to put projects into use”.
