To highly focus on reviewing records and procedures to put transitional renewable energy projects into operation as soon as possible

On 24 May 2023 in Hanoi, the Ministry of Industry and Trade (MOIT) and Vietnam Electricity (EVN) held a conference with the Investor of transitional renewable energy (RE) projects, to clarify and solve the obstacles in the process of carrying out the procedures for negotiating electricity prices and power purchase agreements for projects, to put the projects into operation as soon as possible, and at the same time ensuring the legal provisions.

Attending the conference, there was Mr. Dang Hoang An - Deputy Minister of Industry and Trade, and Mr. Tran Dinh Nhan – EVN’s CEO and President. In addition, there were leaders representatives of the Department of Electricity and Renewable Energy, the Electricity Regulatory Authority of Vietnam, some leaders of EVN, and representatives of leaders of some related departments and units of EVN.

According to updated information up to 24 May 2023, 37 out of 85 renewable energy projects with no price determined have submitted their record to EVN's Electric Power Trading Company (EVNEPTC) to serve the negotiation process of electricity prices and electricity purchase and sale agreement. For the remaining 48 projects that have not yet submitted records, EVNEPTC has also issued a request document to investors to continue to send and provide project records for negotiation and agreement on electricity prices.

 Large number of investors in transitional renewable energy projects attending conference 

Through the process of reviewing records, negotiating, and basing the conclusions notice of Deputy Prime Minister Tran Hong Ha in Notice No. 182/TB-VPCP dated 17 May 2023, out of 37 projects that have submitted records, on 24 May 2023, EVN received a proposal to apply temporary prices of 24 projects. The two Parties have met and agreed: (i) The temporary electricity purchase price (excluding VAT) is equal to 50% of the maximum price of the electricity generation price bracket for each type of power plant specified in Decision No. 21/QD-BCT dated 07/01/2023 of the Ministry of Industry and Trade; (ii) The official electricity purchase price and the settlement of electricity bills will follow the guidance/decision of the competent authority.

The results so far are as follows:

• There are 19 projects/or partial projects (including wind power plants of Nam Binh 1, VPL Ben Tre, Yang Trung, Cho Long, Hung Hai Gia Lai, Lac Hoa 2, Hoa Dong 2, Vien An, Hanbaram, Huong Hiep 1, Tan Phu Dong, Hiep Thanh, Ia Le 1, Huong Linh 7; Phu My 1, Phu My 3, Thien Tan 1.2, Thien Tan 1.3 and solar power plants in Phuoc Minh commune, Thuan Nam district, Ninh Thuan province (450MWac)) with a total capacity of 1,347MW has been approved by the MOIT, approving a temporary price. EVNEPTC and the Investor are coordinating to soon sign the Power Purchase Agreement.

• There is 1 project (Nhon Hoi Wind Power Phase 2, capacity 30MW): Completed negotiations, currently completing procedures to soon submit to the Ministry of Industry and Trade for approval of temporary prices.

• There are 04 projects with a total capacity of 154MW (including wind power plants: No. 5-Thanh Hai 2, 3, 4, and Cau Dat): EVNEPTC and the Investor have both negotiated and continued to review the record to submit to competent authorities for approval according to regulations.

At the meeting, EVN and EVNEPTC hope that the investors of transitional RE projects would actively cooperate in providing full records for negotiation.

To put the transitional renewable energy projects into operation as soon as possible, EVNEPTC has established many negotiating teams to be ready to discuss and guide to solve problems.

EVN and EVNEPTC hope that project investors (including transitional projects approved by the MOIT with temporary) will actively cooperate in providing a full range of records for negotiation, especially legal records; coordinate with EVNEPTC and the power system operator to immediately carry out the experimental and testing of the power plant, expeditiously organize the acceptance and complete the procedures and submit the commercial operation record (COD) according to the provisions of the signed power purchase agreement (PPA), ensuring compliance with the law.
