Specifically, on August 10, 2023, at the Government headquarters, Deputy Prime Minister Le Minh Khai chaired a meeting on the transfer of BOT power plants of Phu My 3 and Phu My 2.2 to EVN. The meeting was attended by leaders of ministries and agencies: Industry and Trade, Finance, Commission for Management of State Capital at Enterprises (CMSC), EVN, Government Office; leaders of the Ministry of Planning and Investment, and the Ministry of Justice.

At the meeting, the ministries and branches attending the meeting agreed that the Ministry of Industry and Trade (MOIT) proposed to assign EVN to take over the Phu My 3 and Phu My 2.2 power plants, which should be reported to the Prime Minister.
Deputy Prime Minister Le Minh Khai assigned MOIT to study and grasp opinions at the meeting, review and finalize the report on the transfer and receipt of the power plants, and then make a report to the Prime Minister before August 18, 2023.
The Deputy Prime Minister also noted that MOIT should carefully study the provisions of the law on investment in the form of public-private partnerships, the law on public property, and other relevant laws to clarify the legal basis, and authority and make proposals in accordance with regulations and competence of the transfer and take-over of BOT power plants, ensuring timely, strict, safe, and continuous operation of 2 plants, ensuring power supply for production, business and people's daily life. At the same time, it is required to clearly report the legal bases and practice for the proposal of assigning EVN to receive and operate the plants.
Previously, MOIT sent a document to the Prime Minister on the transfer of plants after the BOT contract expires. MOIT proposes the Prime Minister agree to the policy that EVN is assigned to receive, manage, operate, trade, and maintain the plants after the transfer. On the other hand, EVN is assigned to prepare the necessary personnel, resources, and relevant funds to prepare for the plan to receive the plants and participate in the preparation steps to receive the plants with MOIT and other ministries.
Phu My 3 BOT thermal power plant (Ba Ria - Vung Tau), investors are Sembcorp, Kyuden International Corporation, and Sojitz Corporation, is designed with a contracted capacity of 716.8MW. The project contract and BOT contract were signed by the Ministry of Industry (now the Ministry of Industry and Trade) with the investor - BOT Company on May 22, 2001. The plant started commercial operation on March 1, 2004, with a term of 20 years, and was transferred without compensation to the Vietnamese side on March 1, 2024, after the expiration of the contract term.
Phu My 2.2 BOT project (Ba Ria Vung Tau) is invested by EDFI, Summit Global Management II B.V, and TEPCI, with a capacity of 715MW. The BOT contract was signed on September 18, 2001, and operated in 2005. February 4, 2025, is due to be transferred to the Vietnamese side after the 20-year contract expires.
