According to the current legal documents, the suspension of mobilizing the unpriced portion of the Trung Nam – Thuan Nam 450MW solar power plant is based on the following legal documents:
- Document No. 12158/BCT-DTDL dated December 19, 2016 of the Ministry of Industry and Trade directing: “From January 1, 2017, if power plants (except for large power plants, which are of special importance in terms of economy, society, national defense and security as prescribed in Decision No. 2012/QD-TTg dated October 24, 2016 of the Prime Minister and power plants in co-ordination with large power plants, which are of special importance in terms of economy, society, national defense and security as stipulated in Decision No. 4712/QD-BCT dated 2/12 2016 of the Ministry of Industry and Trade) without a power purchase contract or with power purchase contract but the electricity pricing has expired, the Ministry of Industry and Trade requests EVN to direct relevant units not to mobilize these power plants to generate power on the national grid unless the mobilization is necessary to ensure the security of power supply.”
- Article 4 of Circular No. 13/2017/TT-BCT dated August 3, 2017 of the Ministry of Industry and Trade stipulates: “Electricity of Vietnam shall not make payment or payment for electricity bills to power plants when operating and generating power on the grid without officially signing a power purchase agreement. In case these plants shall be mobilized due to the requirement of ensuring the security of power supply, Vietnam Electricity is responsible for reporting it to the Ministry of Industry and Trade, and coordinating with the generating unit in mobilizing, operating and paying electricity bills for the power plant.”
Thus, with the above grounds, the cessation of mobilizing the 172.12 MW capacity portion without a pricing mechanism of Trung Nam - Thuan Nam Solar Power Plant is in compliance with legal documents as prescribed by law.
